Convoke

Terms of Service

These terms are a binding agreement between you and Formation Interactive, LLC, a Delaware limited liability company with a registered address at 8 The Green, STE B, Dover, DE 19901, USA (“Convoke”, “we”, “us”). They govern your use of the Convoke platform at convokerpg.com and any related services.

By creating an account or using Convoke, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

1. Who may use Convoke

You must be at least 13 years old to use Convoke. If you are under 18, you may use it only with the involvement of a parent or guardian who agrees to these terms on your behalf. You must be able to form a binding contract, and you must not be barred from using the service under the laws of your jurisdiction.

Convoke is a social platform where Game Masters set the tone of their own campaigns. Some campaigns contain mature themes. You are responsible for choosing campaigns appropriate to you.

3. Your content

You keep ownership of everything you create on Convoke — your characters, campaigns, messages, lore, maps, notes, and uploads. We claim no ownership of it.

To operate the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), and transmit your content — for the sole purposes of running Convoke, showing your content to the people you have shared it with, and providing the features you use, including the AI features in section 5. This licence exists only so we can run the platform; it ends when you delete the content or your account, except as described in section 9 and in the Privacy Policy.

If you choose to publish content to the Exchange or otherwise make it publicly available, you additionally grant other users permission to copy and adapt that content for their own campaigns within Convoke. That is the point of the feature — please only list content you are happy for others to take and modify, and do not list anything containing information you would not want shared.

You are responsible for your content. You confirm that you have the rights to everything you upload and that it does not infringe anyone else’s rights.

4. Acceptable use

Do not use Convoke to:

Recording or uploading audio containing other people requires their agreement. You are responsible for obtaining it.

5. AI features

Convoke includes AI features — chat summaries (Campaign Scribe), audio transcription, image analysis, content import, and image generation. Using them sends the relevant content to our AI provider for processing, as described in section 6 of the Privacy Policy. Please read it; it explains that chat summaries can include messages written by other players, and can run automatically when a Game Master enables the setting.

If you are a Game Master, please tell your players when AI summaries are enabled for your campaign.

6. Campaigns, Game Masters, and other users

Campaigns are run by their Game Masters, who control membership, content, visibility, and tone. Game Masters are users like you, not our employees or agents, and we do not vet or endorse them.

Content in a campaign is visible to that campaign’s participants and, where a Game Master chooses, more broadly. Conversations you take part in belong to everyone in them; if you leave or delete your account, your messages remain in anonymised form so the conversation still makes sense to the others (see the Privacy Policy, section 9).

Interactions with other users are between you and them. Please treat other players with respect, and report problems to support@convokerpg.com.

7. Paid features

Convoke may offer paid memberships and paid game sessions. These are not currently active; when they are, the following applies and any pricing shown at the point of purchase forms part of these terms.

8. Our intellectual property, and third-party game content

Convoke — the platform, its software, design, and branding — belongs to us and is protected by intellectual property law. These terms give you a limited, personal, non-transferable right to use the service; they do not transfer any ownership to you. Do not copy, reverse engineer, or create derivative works of the platform itself.

Convoke supports tabletop role-playing systems and may reference rules, terminology, and reference material associated with them. Those materials belong to their respective owners. We are not affiliated with, endorsed by, or sponsored by any game publisher. You are responsible for ensuring your own use of any third-party game content complies with the licence that governs it.

9. Suspension and termination

You may stop using Convoke and delete your account at any time from your account settings. Please read section 9 of the Privacy Policy first — deletion does not remove everything you wrote, and campaigns you created are transferred so that other players can continue.

We may suspend or terminate your access if you breach these terms, if your use creates legal risk or harms other users, or if we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to put things right. For serious breaches — particularly those involving harm to others — we may act immediately.

Sections 3 (as to licences already granted), 8, 10, 11, 12, and 13 survive termination.

10. Disclaimers

Convoke is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, that defects will be corrected, or that content will always be preserved. Please keep your own copies of anything you cannot afford to lose. We are not responsible for the conduct of other users or for the content they post.

11. Limitation of liability

To the fullest extent permitted by law, Convoke and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or content, arising out of or relating to your use of the service — whether based in contract, tort, or any other theory, and even if we have been advised of the possibility.

Our total liability arising out of or relating to these terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for fraud, personal injury caused by negligence, or anything else that cannot lawfully be limited.

12. Indemnity

You agree to indemnify and hold harmless Convoke and its members, officers, and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of the service, or your breach of these terms or of anyone else’s rights.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not resolved informally, and each of us waives any objection to venue there.

Please contact us first. Most problems can be sorted out quickly — email support@convokerpg.com and we will try to resolve the issue with you before either of us starts formal proceedings.

If you live in a jurisdiction whose consumer-protection laws give you the right to bring proceedings locally, or grant you rights that cannot be waived by contract, nothing here takes those away.

14. Changes to these terms

We may update these terms as Convoke evolves. We will revise the “last updated” date above, and for material changes we will give notice in the app or by email before they take effect. Continuing to use Convoke after a change means you accept the revised terms. If you do not accept them, please delete your account.
